1. Agreement to Terms

By accessing or using the “Do Not Panic” web service (“Service”), provided by Do Not Panic AS (“Company,” “we,” “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Changes to Terms

We may modify these Terms at any time. Material changes will be reflected by updating the “Last updated” date and, once stable, we may notify you by email for major updates. Continued use after changes constitutes acceptance.

3. Service Description & Availability

Do Not Panic AS offers real-time AI-powered spoken translation via a web interface (the “Service”). Availability of the Service is subject to your payment provider’s supported countries (see Polar’s list here) and the languages we support.

4. Account Registration & Age Restriction

• You must register to use the Service via Magic Link or Google Sign-In.
• We collect your email and, if signing in with Google, your name and avatar.
• You must be at least 16 years old; users under 16 may only register with parental consent.

5. Payments, Credits, Billing & Refunds

• The Service is paid: users purchase “minutes” to conduct AI translations.
• Purchases are processed by our payment processor.
• Rounding: Any partial minute is rounded up. E.g., a 10 min 20 sec conversation is billed as 11 minutes.
• Immediate-start & Withdrawal Waiver: At checkout you must confirm that translation minutes begin immediately and that you waive your statutory 14-day withdrawal right under EU/Norway law. Once minutes are delivered, they are non-refundable.
• Unused minutes are forfeited upon account deletion; no refunds are available thereafter.

6. User Conduct & Prohibited Uses

6.1 Prohibited Conduct

1. Violate any applicable law, regulation, or third-party right (including privacy, publicity, or intellectual property).
2. Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service or any API.
3. Perform any unauthorized API calls, scraping, data-mining, or “bot” activity.
4. Interfere with or disrupt the integrity or performance of the Service (including denial-of-service attacks or overloading our systems).
5. Transmit any viruses, worms, malware, or other harmful code.
6. Use the Service to send unsolicited commercial communications (“spam”) or for phishing.
7. Harass, threaten, or defame others through content you transmit.

6.2 Enforcement & Termination

• We reserve the right, at our sole discretion, to investigate and immediately terminate or suspend your access if you violate these prohibitions or breach any provision of these Terms.
• We may report any activity we suspect is unlawful to law enforcement authorities.

6.3 Indemnification

You agree to indemnify and hold Do Not Panic AS (and its affiliates, officers, directors, and employees) harmless from any claim, demand, loss, or damages (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Service.

7. Security Measures

We implement reasonable technical and organizational measures, including:

• HTTPS/TLS for all traffic;
• AES-256 encryption at rest for stored data;
• Regular backups;
• Automated vulnerability scanning;
• Role-based access control and secure secrets management.

8. Third-Party Services & Data Transfers

We engage third-party service providers for key functions, including:

• Payment processing
• Email delivery
• Analytics
• Infrastructure hosting and content delivery
• Real-time translation services

We host data in the EEA where possible. For transfers outside the EEA, we and our subprocessors rely on EU Standard Contractual Clauses. A complete register of our subprocessors and data-processing agreements is available upon request at [email protected]

9. Termination

We may suspend or terminate your access for any violation of these Terms, without notice. Upon termination, you forfeit any unused minutes.

10. Warranty Disclaimer & Limitation of Liability

10.1. Disclaimer of Warranties

The Service is provided “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE,” without warranty of any kind. To the fullest extent permitted by law, Do Not Panic AS disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that:

• Translations will be accurate, error-free, or suitable for any particular purpose.
• The Service will meet your requirements or operate without interruption, delay, or security vulnerabilities.
• Any defects will be corrected.

10.2. Limitation of Liability

In no event shall Do Not Panic AS or its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from or relating to these Terms or the Service shall not exceed the amount paid by you in the 12 months preceding the event giving rise to liability (or, if you have not made any payments, NOK 100).

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Kingdom of Norway.
• Any dispute arising under or related to these Terms shall be litigated exclusively in the district courts of Oslo, Kingdom of Norway.
• Claims up to NOK 50,000 shall be brought in small-claims court, with simplified procedures and fees.
